The author first draws the origins, in Québec, of the law concerning the safety of mental patients. Then, he discusses the essential elements (dangerousness, custody) of the law now in force, and he insists on its deficiencies (treatment, competency)
The principles of liberty, integrity and right to refuse treatment are then studied in relation to the acutely ill patient who is kept in custody because of his illness and his potential dangerousness.
The author finally formulates some suggestions for a law that will protect not only society but also the mental patients.
