Transnational primary and secondary collective action: an overview of international,European and national legislation

This article reviews international, European and national regulation of transnational primary and secondary collective action. There is no explicit provision mentioning the right to international primary or secondary collective action in the relevant international instruments. Within the European Union, several legally binding instruments refer to the right to collective action but none explicitly refers to transnational secondary action. An overview of national regulation of international secondary action shows that at least some countries require or will require that transnational action be subject to the same limitations as those laid down for national secondary action. The possibility for legitimate transnational collective action needs to be clarified.

Cet article passe en revue la réglementation internationale, européenne et nationale de l'action collective et la grève de solidarité. Les instruments internationaux en rapport avec le sujet ne comportent aucune disposition mentionnant explicitement un droit de mener des actions collectives primaires ou secondaires au niveau international. Dans l'Union européenne, plusieurs instruments légalement contraignants font référence au droit à mener des actions collectives, mais aucun n'évoque explicitement l'action secondaire transnationale. Un aperçu de la réglementation nationale de l'action secondaire internationale montre que certains pays au moins requièrent ou requerront que l'action transnationale répondent aux měmes critères que ceux qui ont été fixés pour les actions secondaires nationales. La possibilité d'actions collectives transnationales légitimes doit ětre clarifiée.

Im Mittelpunkt dieses Artikels steht die internationale, europäische und nationale Regulierung von grenzüberschreitenden primären und sekundären kollektiven Aktionen. In keiner der einschlägigen internationalen Rechtsurkunden ist eine explizite Regelung des Rechts auf internationale primäre oder sekundäre kollektive Aktionen enthalten. In der Europäischen Union erwähnen mehrere rechtsverbindliche Urkunden das Recht auf kollektive Aktionen, keine jedoch nimmt explizit Bezug auf grenzüberschreitende sekundäre Aktionen. Eine Prüfung der nationalen Bestimmungen zu internationalen sekundären Aktionen ergibt, dass zumindest einige Länder verlangen, oder verlangen werden, dass grenzüberschreitende Aktionen den gleichen Auflagen unterliegen, die auch für nationale sekundäre Aktionen gelten. Die Möglichkeiten zur Durchführung legitimer grenzüberschreitender kollektiver Aktionen müssen geklärt werden.
