Abstract
Corporate social responsibility (CSR), in association with sustainable development, has become a live issue over the past few years. Should companies be allowed to do whatever they like in the name of competitiveness, even at the risk of compromising the future of the planet? What means does the trade union movement currently have at its disposal to influence corporate conduct in the direction of sustainable development and social responsibility? Over and above traditional trade union activities, the unions have available to them a tool, namely the funds which they manage – or jointly manage – in connection with occupational pension or employee savings schemes. By having their say in the investment strategies of these funds, trade unions can make decisions that affect corporate conduct. This is what is now known as socially responsible investment (SRI).
This article sets out to explore the issue, demonstrating how we have moved on from what was initially a moral, ethical approach, geared mainly towards ‘exclusion', to a more incentive-based approach seeking to encourage companies whose conduct is more ‘responsible'. In other words, we shall show that occupational pension funds can in fact become a new weapon in the trade union armoury.
La question de la responsabilité sociale des entreprises en lien avec le développement durable se pose avec acuité depuis quelques années. Une entreprise au nom de la compétitivité peut-elle faire tout et n'importe quoi, au risque de compromettre l'avenir měme de la planète ? De quels moyens dispose aujourd'hui le mouvement syndical pour infléchir de tels comportements? Audel à des actions traditionnelles qu'il peut mener, il dispose d'un outil celui que lui offre les fonds qu'il gère, ou dans lesquels il intervient, dans le cadre des régimes de pension professionnelle ou de l'épargne salariale. En effet, en intervenant dans les stratégies d'investissement de ces fonds, il peut peser, par les choix qu'il opère, sur le comportement des entreprises. C'est ce que l'on appelle aujourd'hui « l'Investissement Socialement responsable » (l'ISR).
Cet article essaie donc de faire le tour de la question, en montrant comment à partir d'une approche historiquement d'abord « morale », « éthique », plutôt orientée vers « l'exclusion », l'on est passé à une approche plus « incitative », visant à encourager les entreprises qui avaient un comportement plus « responsable ». Autrement dit, comment les fonds des pensions professionnelles, peuvent en fait devenir un des nouveaux leviers de l'action syndicale.
Die soziale Verantwortung der Unternehmen (CSR – corporate social responsibility) ist in den letzten Jahren zusammen mit der nachhaltigen Entwicklung ein viel diskutiertes Thema geworden. Sollten Unternehmen im Namen der Wettbewerbsfähigkeit machen können, was sie wollen, auch auf die Gefahr hin, dass die Zukunft des Planeten aufs Spiel gesetzt wird? Welche Mittel stehen den Gewerkschaften derzeit zur Verfügung, um das Verhalten von Unternehmen in Richtung nachhaltige Entwicklung und soziale Verantwortung zu beeinflussen? Neben den klassischen Gewerkschaftsaktivitäten bietet sich den Gewerkschaften noch ein weiteres Mittel an: die von ihnen verwalteten Fonds – oder gemeinsam verwalteten Fonds –betrieblicher Renten- oder Sparpläne. Die Gewerkschaften können mit ihrer Stimme die Investitionsstrategien dieser Fonds mitbestimmen und Entscheidungen herbeiführen, die das unternehmerische Verhalten beeinflussen, was gemeinhin als sozialverantwortliche Investition bezeichnet wird. Bei der Auseinandersetzung mit diesem Thema zeigt der vorliegende Beitrag auf, wie wir uns allmählich von einem moralisch-ethischen Ansatz entfernt haben, bei dem es meist um ‘Ausschluss’ ging, und wie sich ein stärker auf Anreize setzender Ansatz durchgesetzt hat, mit dem Unternehmen zu einem ‘verantwortungsvollen’ Verhalten ermutigt werden. Kurzum, wir zeigen auf, dass betriebliche Rentenfonds als neue Waffe im Arsenal der Gewerkschaften tatsächlich Wirkung erzielen.
