The Services Directive: the legislative process clears the first hurdle

In January 2004 the European Commission put forward a proposal for a Directive on services in the internal market that triggered considerable controversy both within the European institutions and amongst the public at large. It was praised by its proponents as a breakthrough for the internal market and sharply criticised by opponents as being a neoliberal abandonment of the Community approach that would merely encourage social and ecological dumping. This paper looks beyond the polemics, myths and ideological battles associated with the issue and attempts to examine the core elements of the proposal in order to identify its objectives and the problems associated with it. It also traces the intensive work carried out by the European Parliament, which discussed the proposal over a period of two years before coming to a decision on it. The ETUC critically monitored the Parliament and the Council during this process, articulating its demands very clearly — and with a large degree of success — through a combination of intensive lobbying and demonstrations.

En janvier 2004, la Commission européenne publiait une Directive cadre sur les services dans le marché intérieur qui a soulevé une vaste controverse tant au sein des institutions européennes que dans le grand public. Ses promoteurs y voyaient une grande avancée pour le marché intérieur tandis que ses opposants dénonçaient un reniement de la démarche communautaire au profit du néolibéralisme qui ne ferait qu'encourager le dumping social et environne-mental. Le présent article s'efforce de dépasser la polémique, les mythes et les conflits d'idées pour tenter d'étudier les éléments de fond de la proposition afin d'identifier ses objectifs et les problèmes qu'elle souléve. Il fait aussi le bilan des travaux du Parlement européen qui a discuté de la question pendant plus de deux ans avant d'arriver à une décision. Pendant ce temps, la CES a suivi ces travaux d'un œil critique, de même que ceux du Conseil, en formulant trés clairement ses revendications et en conjuguant lobbying intensif et manifestations pour obtenir largement gain de cause.

Die Europäische Kommission hat im Januar 2004 einen Vorschlag für eine Rahmenrichtlinie Dienstleistungen vorgelegt, der äuβerst kontrovers diskutiert wurde, sowohl innerhalb der europäischen Institutionen als auch in einer breiteren Öffentlichkeit: von Befürwortern hoch gepriesen als Durchbruch zur Realisierung des Binnenmarkts, von Gegnern scharf kritisiert als neoliberale Abkehr von der Gemeinschaftsmethode, die Sozial- und Ökodumping fördere. Jenseits von Polemik, Mystifizierungen und ideologischen Schlachten gilt es im Folgenden, die Kernpunkte des Vorschlags zu rekonstituieren, das Ziel und die Probleme aufzuzeigen. Ebenfalls ist es sinnvoll, die intensive Arbeit des Europäischen Parlaments nachzuverfolgen, das zwei Jahre über diesen Vorschlag diskutiert hat, bevor er entscheidungsreif war. Bei dieser Arbeit hat der EGB das Parlament und den Rat kritisch verfolgt und seine Forderungen gegenüber dem EP mittels vielfältiger Aktivitäten — sowohl Überzeugungsarbeit als auch Demonstrationen — und durchaus erfolgreich deutlich gemacht.
