Abstract

By the time these words are read, the outcome of the Court of Appeal's deliberations in Savage v South Essex Partnership NHS Trust (duties under Articles 2 and 8 towards psychiatric patients) and in the indexation cases is likely to be known. Both judgments will have huge significance for the NHS, subject to any further appeal to the House of Lords. Healthcare and Law Digest will provide detailed reports as soon as practicable.
This issue continues the mental health theme begun in the September 2007 issue and perpetuated by the Savage case. Simon Lindsay provides another thoughtful analysis, this time on the subject of the new community treatment regime.
To conclude, two case reports cover, respectively, a dispute over expert evidence and obstetric liability, both familiar themes to readers of this column.
